The petitioner seeks bail in Barharia P.S. Case No.299 of 2018 registered under Section 307 and other Sections of the Indian Penal Code.

The informant named the petitioner and other accused persons and alleged that they all abusing the informant. When the informant forbid them, Sajid Anwar pushed the informant. Majid Ali, the cousin of the informant came to save on such, Sadik Mian, the petitioner exhorted his son Md. Sajid and Md. Sajid assaulted Majid Ali with Tangi on his head. The learned counsel for the petitioner submits that petitioner is an order giver. No allegation of assault is made against the petitioner.

Considering the facts that no allegation of assault is

Patna High Court Cr.Misc. No.75719 of 2018(2) dt.18-12-2018 2/2 made against the petitioner and the petitioner is only an order giver, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Barharia P.S. Case No.299 of 2018.
