JUSTICE SANJAY PRIYA ORAL ORDER 2/ 19-12-2018 This application has been filed for modification of the order dated 12.04.2018 passed in Cr. Misc. No.12840 of 2018 by which petitioners have been granted anticipatory bail in connection with Shikarpur P.S. Case No.259 of 2016 to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran.

Counsel for the petitioners submits that petitioners could not surrender because petitioner no.1 became ill and he was under treatment of Dr. H. Ahmed from 10.04.2018 to 08.09.2018. Medical prescription of the petitioner no.1 has been annexed as Annexure-2. Petitioner No.2 is wife of petitioner no.1 and she remained busy in taking care of her husband.

Patna High Court Cr.Misc. No.76290 of 2018(2) dt.19-12-2018 2/2 In view of such, four weeks' further time from the date of receipt of copy of this order is granted to the petitioners to surrender before the Court below and, in that event, the Court below will release the petitioners on bail as per order dated 12.04.2018 passed in Cr. Misc. No.12840 of 2018. This Modification Application is, accordingly, allowed.
