====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 18-12-2018 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Jainagar P.S. Case No. 509 of 2018 instituted for the offence under Sections 307, 323, 324, 341, 342, 379, 448 and 504/34 of the Indian Penal Code. Counsel for the petitioner submits that petitioner and informant are own brothers. The occurrence has taken place due to family dispute. Allegation against the petitioner is that he assaulted the informant with Farsa on his head causing injury to him.

The injury report of the informant has been enclosed as Annexure-2 wherein the Doctor has found the injury on the person of the informant to be simple in nature caused by hard and blunt substance.

Patna High Court Cr.Misc. No.74909 of 2018(2) dt.18-12-2018 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Madhubani/In charge Successor Court in connection with Jainagar P.S. Case No. 509 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
