This application for anticipatory bail arises out of Complaint Case No. C-1/25 of 2013, disclosing offences under Section 420 of the Indian Penal Code.
The allegation against the petitioner is that he has executed a sale deed in respect of a land which belongs to the complainant.
Learned counsel appearing on behalf of the petitioner asserts that as a matter of fact, the said land belongs to the petitioner in respect of which sale deed has been executed and there is a title suit pending between the parties.
Patna High Court Cr.Misc. No.72934 of 2018(2) dt.18-12-2018 2/2 Considering the above submission, this application is allowed. Let the petitioner above-named, in the event of his arrest or surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar in Complaint Case No. C-1/25 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
