2. The petitioner has preferred this application for grant of regular bail in connection with Bidupur P.S. Case No. 403 of 2023 dated 13.07.2023 registered for the offence punishable u/ss 457, 380 and 411 of the Indian Penal Code.

3. As per the prosecution case, unknown miscreants are alleged to have committed theft in the house of the informant's brother and stolen jewellery worth Rs. 7 lacs and Rs. 10 lacs in cash.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The seized articles recovered from the house of the

Patna High Court CR. MISC. No.83122 of 2023(4) dt.10-04-2024 2/2 petitioner belongs to his family members. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the self-confessional statement. The other co-accused person has already been granted anticipatory bail by this court vide order dated 13.02.2024 passed in Cr. Misc. No. 1348 of 2024. The petitioner has two antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 16.08.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 403 of 2023.

7. The application stands allowed.
