JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-12-2019 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with R.P.F. Post Kiul P.S. Case No. 04 of 2019 for the offence under Section 3 of the R.P. (U.P.) Act.

Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent and they are in custody since 19.08.2019. He further submits that the name of the petitioners surfaced on the basis of confessional statement of co-accused. He also submits that the similarly circumstanced co-accused, namely, Vikky Kumar @ Sanjiv Kumar, has been granted bail vide order dated 29.11.2019 passed in Cr. Misc. No. 73262 of 2019.

No.81503 of 2019(2) dt.11-12-2019 2/2 Considering the fact that the petitioners have got no criminal antecedent and also the fact that the similarly circumstanced other accused person has been granted bail, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Railway Magistrate, Kiul in connection with R.P.F. Post Kiul P.S. Case No. 04 of 2019.
