The petitioner seeks regular bail in connection with Wazirganj P.S. Case No. 231 of 2018 for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(a) (d) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 225 liters of illicit liquor from a bolero jeep and the petitioner had fled away upon seeing the police.
The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the fact is that the petitioner was arrested in connection of one other case i.e. Wazirganj P.S. Case No. 328 of 2018 and thereafter the
Patna High Court Cr.Misc. No.74986 of 2018(2) dt.14-12-2018 2/2 petitioner has been implicated in the present case without any basis. It is submitted that the petitioner is an accused in the aforesaid Wazirganj P.S. Case No. 328 of 2018 and in one other case in which he is on bail. It is further submitted that the petitioner was arrested on 14.10.2018 in the aforesaid other cases and was remanded in the present case on 26.10.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Gaya in connection with Wazirganj P.S. Case No. 231 of 2018.
