This application is for grant of regular bail in connection with Naubatpur P.S.Case No.472 of 2019 dated 16.7.2019 for the offences under Section 395 of the Indian Penal Code.

Allegation against the petitioner is about robbery of coins amounting to Rs.18,41,000/-. Petitioner is named in the FIR and later on his name transpired on the confession of the co-accused and apart from that it appears that he is accused in seven other cases.

Submission of the learned counsel for the petitioner is that except the confession, there is nothing against him and other co-accused has been granted bail, vide order dated 18.12.2019 passed in Cr. Misc. No.73122 of 2019. There

Heard learned A.P.P. , who has opposed the prayer for bail stating that apart from the confessional statement, the tower location of the petitioner shows his presence near the place of the occurrence and he was continuously in touch with the other accused persons..

Having heard both sides and in view of submissions as made above, I am not inclined to grant bail to the petitioner at this stage, however, once the charge has been framed , petitioner is at liberty to renew his prayer for bail. With the aforesaid observation, this application is dismissed.
