Petitioners are seeking anticipatory bail in connection with Complaint Case No.1088(C) of 2017 registered for the offences punishable under Sections 406 and 420 of the I.P.C. and Section 138 of the N.I. Act.

Learned counsel for the petitioners submits that the petitioners are willing to deposit a sum of Rs.2,50,000/- subject to result of the case in the court below. It is a case of alleged dishonour of the cheque of Rs.1,00,000/- for insufficient fund. No one appears for the State to oppose this application.

No.76185 of 2018(2) dt.21-12-2018 2/2 In the facts and circumstances of the case, if the petitioners deposit a sum of Rs.2,50,000/- in two installments of Rs.1,25,000/- each, first of which will be deposited within four weeks from today, in case of arrest or surrender of the petitioners within a period of four weeks from today, the abovenamed petitioners shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) each with two sureties of the like amount each to the satisfication of the learned A.C.J.M.-V, Danapur in connection with Complaint Case No.1088(C) of 2017, subject to the condition under Section 438(2) of the Cr.P.C. If the petitioner fails to abide by the promise to deposit the amount of Rs.2,50,000/- as stated above within two months from today, the court below shall cancel the bail bond and will proceed with the matter. The application is disposed off accordingly.
