Petitioners seek bail in Thakurganj P.S. Case No. 124 of 2018 instituted for the offence under Section(s) 413 and 414 Indian Penal Code.

It is alleged in the written report that one Motorcycle has been recovered from house of petitioner No. 2. As per seizure list one Motorcycle has been recovered from Verandah of petitioner No. 2.

Counsel for the petitioners submits that the house from where the Motorcycle has been recovered, is joint house of petitioner No. 1. There is no recovery from conscious possession of petitioner No. 1. The recovery has been made

Patna High Court Cr.Misc. No.73999 of 2018(2) dt.11-12-2018 2/2 from Verandah of petitioner No. 1. Counsel for the petitioner further submits that petitioners are in custody since 6.9.2018 having clean antecedent.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Thakurganj P.S.
