JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2019 This is an application for grant of anticipatory bail in connection with Janki Nagar P.S. Case No. 51 of 2016, disclosing offences under Sections 147, 148, 341, 342, 323, 324, 379, 325, 504, 506, 307/34 of the Indian Penal Code. Allegation against the petitioner and other accused persons is of assault to the son of the informant and also allegation of forcibly dashed the tractor over the son of the informant and further allegation of snatching rupees one lakh five thousand from him.

Submission of learned counsel for the petitioner is that the whole allegation is false and concocted and the petitioner has no criminal antecedent.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail of the petitioner stating that injury is

Having heard both sides, in view of the above facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court. Accordingly, this application is dismissed.
