JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-03-2020 The petitioner who is in custody since 21.05.2019 seeks bail in connection with Nathnagar (Madhusudanpur) P.S. Case No. 120 of 2019 instituted for the offences under Section 392 of the Indian Penal Code.

The name of the petitioner has transpired in the confession of an arrested accused person viz. Lalan Yadav. There is no recovery of any incriminating article from the constructive possession of the petitioner. Despite the petitioner having remained in custody for a long period, he has not been put on Test Identification

In one of the two cases in which the petitioner has been earlier made accused, he has been granted bail. In the other case, the petitioner stands convicted and it has been submitted that an appeal has already been filed.

Considering the period of custody of the petitioner in the present case, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousands) with sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Nathnagar (Madhusudanpur) P.S. Case No. 120 of 2019.
