The petitioner is languishing in custody since 30.07.2019 in a case registered for the offences punishable under Sections 25 (1-B)a of the Arms Act.

It is alleged that from the possession of the petitioner, one double barrel gun and four live cartridges were recovered.

It is submitted by learned counsel for the petitioner that the petitioner has been framed in the present case and the investigation has already been concluded. Though a statement has been made in paragraph no.3 of the petition that the petitioner is accused in one other case lodged under the provisions of the Bihar Prohibition and Excise Act, 2016.

Patna High Court CR. MISC. No.74687 of 2019(2) dt.04-12-2019 2/2 Learned APP for the State submits that the said recovery has been made from the possession of the petitioner. Considering the fact that the investigation has already been concluded and apart from the present case, the petitioner has not been made accused in any case under the provisions of Arms Act and the period under custody, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Purnea, in connection with K.
