JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Makhdumpur P.S. Case No. 164 of 2018 for the offence under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that although the petitioner has got criminal antecedent, but he is in custody since 25.06.2018. He submits that the name of the petitioner figured in the instant case only on the basis of confessional statement of Brajesh Paswan. He further submits that nothing has been recovered from the possession of the petitioner.

Considering the period of custody, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two

Patna High Court Cr.Misc. No.79603 of 2018(2) dt.11-01-2019 2/2 sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Jehanabad in connection with Makhdumpur P.S. Case No. 164 of 2018 with the following conditions:

(i) The bailors should be the elected representative of the local bodies.

(ii) The petitioner shall extend full co-operation in the trial.

(iii) If the petitioner would be found in tampering the witnesses or causing delay in disposal of the case, the trial court shall be at liberty to cancel his bail bonds. (Anil Kumar Upadhyay, J) uday/- U T
