JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 Petitioners seek regular bail in connection with Suiya P. S. Case No. 10 of 2019 registered for the offence punishable under Sections 302, 34, 201 and 120(B) of IPC. As per prosecution case brother of the informant went out of the house to collect some money and when the informant called him on his mobile he has not received the same. Later on his dead body was found in the Khurtha Bahiyar. The informant suspect the hand of other two accused persons. Submission of the learned counsel for the petitioners is that petitioners are not named in the F.I.R., later on petitioners name were transpired on the suspicion of the informant that there is a land dispute between the parties. Patna High Court CR. MISC. No.73958 of 2019(3) dt.16-01-2020 2/2 custody for about four months, charge-sheet has also been submitted, as such, there is no chance of tempering with the evidence.

Heard learned A.P.P. also who could not controvert the above fact.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioners above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Suiya P. S. Case No. 10 of 2019, subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
