Petitioner seeks bail in Raghunathpur P.S. Case No.119 of 2018, registered under Sections 272, 273, 308 and 34 of the Indian Penal Code and under Sections 30A/38A/41(1) of the Bihar Prohibition and Excise Act, 2016.

About 987.12 liters of liquor was recovered from the field of Shambhu Khan. Mustafa Khan was arrested on spot and he is said to have disclosed the name of the petitioner and others.

Learned counsel for the petitioner submits that petitioner was neither apprehended on the spot nor anything was recovered from possession of the petitioner. Other accused persons have been enlarged on either anticipatory or regular bail. Even Mustafa Khan has already been granted bail vide

Patna High Court Cr.Misc. No.75662 of 2018(2) dt.18-12-2018 2/2 order passed in Cr. Misc. No.53998 of 2018.

Considering the facts aforesaid, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-II-cum-Special Judge, Excise Act, Siwan in connection with Raghunathpur P.S.
