Petitioners seek bail in Dawath P.S. Case No. 132 of 2018 instituted for the offence under Section(s) 30(a), 35 and 38 of the Bihar Prohibition and Excise Act, 2016. It is alleged in the written report that on getting secret information police party reached at the place of occurrence and saw one truck and one Pick-up Bolero were standing there. Seeing the police party, 10 to 15 persons started running away but on chase two persons were arrested who disclosed their name as petitioners. On search, total 8147.52 litres of foreign liquor has been recovered from aforesaid vehicles.
Patna High Court Cr.Misc. No.73237 of 2018(2) dt.07-12-2018 2/2 Considering the huge quantity of liquor recovered from the aforesaid vehicles, this Court is not inclined to grant bail to the petitioners at this stage. Accordingly prayer for bail of petitioners is rejected.
Petitioners are given liberty to renew the prayer for bail after six months in the event no substantive progress is made in trial.
