The petitioner seeks regular bail in connection with Araria P.S. Case No. 357 of 2018 for the offences punishable under Sections 399/402 of the Indian Penal Code. The allegation is regarding the police having apprehended two accused persons including the petitioner herein on the suspicion of them preparing for committing dacoity and as far as the petitioner is concerned one country made revolver was recovered for which a separate case bearing Araria P.S. Case No. 356 of 2018 was lodged.
The learned counsel for the petitioner submits that apart from the present case and aforesaid case which arises out of the same incident, the petitioner is having a clean antecedent.
Patna High Court Cr.Misc. No.74897 of 2018(2) dt.14-12-2018 2/2 It has been further submitted that the petitioner has been falsely implicated in the present case. The petitioner is stated to be in custody since 12.06.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 357 of 2018.
