The petitioner seeks regular bail in connection with Sugauli P.S.Case no.441 of 2017 registered for offences punishable under Sections 395, 328 of the Indian Penal Code. Allegation is of looting of the truck after administering medicine to the informant and his Khalasi and the FIR is against the unknown.

Submission of the learned counsel for the petitioner is that on confession, his name transpired and except that there is nothing against him and nothing has been recovered, not put on TIP and he is in custody since13.8.2018 though he is accused in three other cases but he is on bail in those cases. Heard learned A.P.P. also.

No.73911 of 2018(2) dt.17-12-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari, East Champaran in connection with Sugauli P.S.Case No.441 of 2017..

With the aforesaid observation, this application is allowed.
