The petitioners seek bail in connection with Sandesh P.S. Case No. 143 of 2025 instituted for the offence under Section 309(4) of the Bharatiya Nyaya Sanhita, 2023. 3.

The prosecution case, in brief, is that on 29.06.2025 at about 03:23 A.M., three bike-borne armed persons entered the informant's sand office at Pandura Road, Deuar, and looted a bag containing Rs. 2,66,000/-. 4.

It has been submitted on behalf of the petitioners

Patna High Court CR. MISC. No.80980 of 2025(2) dt.15-12-2025 2/3 that the petitioner No.2 is in custody since 21.07.2025, whereas petitioner Nos. 1 & 3 are in custody since 19.07.2025. Petitioner Nos. 1 & 2 bear one criminal antecedent each, whereas petitioner No. 3 bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application. 5.

It has been further submitted by the petitioners' counsel that petitioners have been falsely implicated in the present case. Petitioners are not named in the FIR. Name of the petitioners have transpired on the basis of confessional statement of co-accused, namely, Shubham Kumar and the same has no evidentiary value in the eye of law. Nothing has been recovered from the conscious possession of the petitioners. Charge sheet has already been submitted in this case. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioners and charge sheet being submitted, this Court is inclined to grant bail to the petitioners.

Let the petitioners be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteeen Thousand) each with two sureties of the like amount each to the satisfaction of Court
