JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Darbhanga Sadar P.S. Case No. 15 of 2019 for the offence under Sections 363, 366(A) of the Indian Penal Code and Section 10 of the POCSO Act.

Allegation against the petitioner is that despite assurance in the Panchayat he has not handed over the daughter of the informant to him. He further submits that the petitioner has got no criminal antecedent and he is in custody since 18.02.2019. In para 8 of the petition, specific statement has been made that the daughter of the informant has delivered a male child on 11.09.2019 and the boy and girl (son of the petitioner and daughter of the informant) are living happily as husband

Considering the above, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-cum-Special Judge, POCSO Act, Darbhanga in connection with Darbhanga Sadar P.S. Case No. 15 of 2019 with the condition that the petitioner is required to produce the daughter of the informant before the Court below and on production of the girl, the court below shall release the petitioner.
