The petitioner seeks regular bail in connection with Basnahi P.S. Case No. 92 of 2018 for the offenses punishable under Section 30(a) of the Bihar Prohibition and Excise Act. The allegation is regarding recovery of small quantity of illicit Mahua liquor from the motorcycle of the petitioner herein.

From the record it appears that the petitioner has been falsely roped in the present case.

The learned counsel for the petitioner submits that the petitioner is having no criminal antecedent as also he is languishing in custody since 04.09.2018.

Having regard to the facts and circumstances of the

Patna High Court Cr.Misc. No.74708 of 2018(2) dt.14-12-2018 2/2 case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Saharsa in connection with Basnahi P.S. Case No. 92 of 2018.
