Petitioner seeks bail in Chandi P.S. Case No.139 of 2018 instituted for the offence under Section(s) 302, 120-B/34 Indian Penal Code.

Counsel for the petitioner submits that informant is not the eye witness of the case. The informant has admitted that there was land dispute.

It is alleged that on telephone she got information that her husband has been shot dead by unknown criminals. The informant has raised suspicion against her brother-in-law (Bahnoi), Mahesh Prasad, and cousin brother, Raja Ram Prasad, for committing murder of her husband due to land dispute. From the impugned order, it appears that charge-sheet

Patna High Court Cr.Misc. No.74658 of 2018(2) dt.13-12-2018 2/2 has already been submitted by the police.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Chandi P.S.
