The petitioner seeks bail in a case instituted for the offences under Sections 341, 323, 379/34 of the Indian Penal Code in which sections 307 and 302 IPC were added later on. The prosecution case in short is that the accused persons entered into the house of the informant and assaulted her husband due to which he sustained injury and later succumbed to the injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.9.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been

As per F.I.R., general and omnibus allegation has been made against the petitioner and other accused persons. No weapon has been disclosed by the informant which was used in the occurrence. The informant is an eye witness to the occurrence. As per the post-mortem report, the deceased has sustained injury caused by hard and blunt substance. This fact is not supported from the F.I.R. Other coaccused has been granted bail vide order dated 22.5.2019 passed in Cr. Misc. No. 25245 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Begusarai in connection with Muffasil P.S. Case No. 691/2018.
