2. The petitioner seeks bail in connection with Dhankund P.S. Case No. 64 of 2024 instituted for the offences under Sections 302, 120B of the Indian Penal Code.

3. Accusation against the accused persons including the petitioner is of committing the murder of the informant's husband.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel for the petitioner submitted that general and

Patna High Court CR. MISC. No.83381 of 2024(3) dt.23-04-2025 2/3 omnibus allegation has been made against the petitioner. There is no eye-witness to the alleged occurrence. No specific overt act is alleged against the petitioner. Learned counsel further submitted that there is already land dispute between the parties and therefore, the petitioner is being dragged in this case. It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.06.2024 and has one criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Learned APP further submitted that as per paragraph no. 8 of the case diary, this co-accused Sargun Yadav has confessed his guilt and specifically narrated the manner in which he along with other accused persons including the petitioner committed the murder of the deceased.

6. Considering the aforesaid facts and circumstances of the case, there being no specific material against the petitioner that cropped up during course of investigation as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court
