The petitioners seek bail in Phulparas P.S. Case No.108 of 2018 registered under Sections 272, 273 of the Indian Penal Code and Section 30(a) and (d) of Bihar Prohibition and Excise Act.
The police recovered more than 700 liters of different brands of Indian made foreign liquor. Nobody was apprehended on the spot but the petitioners are named in the F.I.R. on the basis of the disclosure said to have been made by Choukidar. Choukidar claimed that in the light of cell, he identified the petitioners.
Considering the aforesaid facts and the fact that

No.75344 of 2018(2) dt.17-12-2018 2/2 petitioners are not apprehended on the spot and the fact that the petitioners are in jail for about three months, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.5,000/-(Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge IInd-cum-Special Judge, Excise Act, Madhubani in connection with Phulparas P.S.
