Petitioner seeks bail in a case registered under Sections 30 (a), 35, 38 of the Bihar Prohibition and Excise Act, It is submitted by the petitioner's counsel that the petitioner has falsely been implicated in this case on the alleged recovery of 326 liters of liquor. It is pointed out that though the recovery is alleged to have been made in front of Village - Bodhchatra, the seizure list witnesses are only police personnel and no villager has been made seizure list witness. Petitioner submits that he has been implicated in this case as he was only passing through the field. He submits that he has been falsely

Patna High Court Cr.Misc. No.75813 of 2018(2) dt.17-12-2018 2/2 implicated in this case and prior to this case, he has no criminal antecedent. He is in custody since 10.10.2018. Considering the aforementioned submissions and the facts and circumstances of the case, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II -cum- Special Judge, Excise, Rohtas at Sasaram in Dawath Police Station Case No 146 of 2018 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
