The petitioner seeks bail in connection with Mansi Rail P.S. Case No.25 of 2018, registered for the offence under Sections 468,471 & 420 of the Indian Penal Code and Sections 25(1-B)A and 26 of the Arms Act.

It is contended by learned counsel for the petitioner that licence of the gun was provided to the petitioner by the management of the Bandhan Bank, where he was doing his duty as a security guard. He further contented that the petitioner was not at all aware of the fact that the licence provided to him was forged one. He contended that the illegality, if any, was because of poverty and illiteracy of the petitioner as in order to meet the need of his family, he had agreed to do job in the Bank and the arm and the licence was provided to him by the management. Learned counsel for the State has opposed the prayer

Patna High Court CR. MISC. No.74608 of 2019(2) dt.11-12-2019 2/2 for grant of bail.

Considering the fact that the petitioner is in custody since 06.08.2019 and having got roots in the society he is not likely to abscond or tamper with the evidence, the prayer for bail is allowed.

The petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Railway, Khagaria in connection with Mansi Rail P.S. Case No.25 of 2018.
