This is a case registered under Sections 21(C) , 22 of the NDPS Act.
It is submitted by petitioner's counsel that he was a cleaner of the vehicle in question and had no knowledge about the consignment as the same belongs to one Md. Juber. The petitioner has no criminal antecedent and he is in custody since 18.08.2018 on the allegation of recovery of some cough syrup from the vehicle in question.
In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like
Patna High Court Cr.Misc. No.75938 of 2018(2) dt.17-12-2018 2/2 amount each to the satisfaction of learned Sessions Judge-cumSpl. Judge, Araria in Narpatganj P.S. Case No. 494 of 2018 in subject to the conditions :
(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.
(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
