JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioner seeks bail in connection with Nardiganj P.S.Case No. 204 of 2018 registered under Sections 323, 341, 353, 504 and 506 of the Indian Penal Code and 30(d) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 95 litres of country made wine including English wine from the possession of the petitioner and it is stated that when police arrested him accused persons attached on the police party also and petitioner has one more case.

Submission of learned counsel for the petitioner is that petitioner has been falsely implicated in this case which will appear from the seizure list that the recovery is made near Nadirganj college whereas in the later column, it has been stated that recovery is from the house of the petitioner and he is in

Patna High Court Cr.Misc. No.76493 of 2018(2) dt.21-12-2018 2/2 custody since 01.11.2018.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II-cum-Spl. Judge, Nawada in connection with Nardiganju P.S.Case No. 204 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
