JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 This is an application for grant of anticipatory bail in connection with Deepnagar P.S. Case No. 326 of 2018, disclosing offences under Section 30(a) of Bihar Excise (Prohibition) Amendment Act, 2016.

Allegation as per F.I.R. is of recovery of 277.5 liters liquor from a field and one person namely Guddu Ram was arrested and he has disclosed the name of the petitioner and two other accused persons.

Submission of learned counsel for the petitioner is that other co-accused persons having similar allegation have been granted privilege of anticipatory bail by a Coordinate Bench of this Court vide order dated 26.10.2018 passed in Cr. Misc. No. 65351 of 2018. Further, the petitioner has no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional District and Sessions Judge-cum-Special Judge (Excise), Nalanda at Biharsharif, in connection with Deepnagar P.S.
