Petitioner seeks bail in Barachatti P.S. Case No. 327/2018 registered for the offences punishable under Sections 8/20 of the N.D.P.S. Act.

Informant has alleged that on 17.05.2018 he checked a truck and found two bags containing 50 k.g. of Ganja behind the driver seat in which two persons were sitting including the petitioner.

Considering the facts and circumstances of the case and also in view of the fact that there being recovery of huge quantity of Ganja, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.

However, the court below is directed to expedite the trial and conclude the same within one year from the date of

Patna High Court Cr.Misc. No.78148 of 2018(2) dt.09-01-2019 2/2 receipt of the order. If the trial is not concluded within one year, the petitioner would be at liberty to renew his prayer for bail. (S. Kumar, J) Sanjay/- U T
