Allegation, as per the FIR, is that while the informant was coming from Patna Junction, two persons came on a motorcycle and tried to snatch his mobile and money and one card of him was also fallen. Petitioner is not named in the FIR. Submission of learned counsel for the petitioner is that he has been named only on the basis of confessional statement of co- accused and petitioner has no criminal antecedent. Heard learned APP also.

Having heard both sides and in the nature of allegation, this is not a case for grant of anticipatory bail. Hence, prayer of anticipatory bail is rejected. If petitioner surrenders and prays

Patna High Court Cr.Misc. No.77776 of 2018(2) dt.02-01-2019 2/2 for regular bail, the same shall be considered by the learned court below on its own merit without being prejudiced by this order.
