2. The petitioner has prayed for bail in a case registered for the offence punishable under Sections 319(2), 318(4) & 303(2) of B.N.S.

3. The case of the prosecution is that the informant has purchased an auto. He was going with the passengers to Siris. As he reached near Keshav market, certain persons in a Scorpio stopped him and told him to leave the auto as he has not paid the installments of the Bank. The driver of the auto got out of it and the miscreants took away the auto. The FIR was lodged against unknown miscreants. The name of this petitioner has surfaced in the confessional statement of the co-accused Krishna Kumar.

4. Learned counsel appearing on behalf of the petitioner has submitted that nothing has been recovered from the possession of this petitioner rather the auto was recovered from the possession of co-accused persons. The petitioner is in custody since 14.09.2024.

5. The application for bail is opposed by learned APP for the State. He submits that the petitioner is having criminal antecedent of seven cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 401 of 2024.

7. Accordingly, the present bail application stands allowed.
