The petitioner has filed the present writ petition for directing the respondents to make payment of the remaining bill of the petitioner in connection with Agreement no. 6F2/2011-12 and 7F2/2011-12 coupled with money withheld for Time Extension which is not being paid for want of fund by the concerned respondent inspite of the work in question having been completed fully, long time back. The petitioner has further prayed for payment of earnest money and security deposit in connection with the said work.

Having regard to the limited nature of the prayer of the petitioner herein, it would be appropriate to relegate the petitioner to the remedy of filing an appropriate claim before the respondent no. 3 within a period of four weeks from today which shall be disposed of by the respondent no. 3 by a reasoned and speaking order within a period of twelve weeks thereafter. It is needless to state that in case, no final decision is taken within a period of twelve weeks from filing of the representation of the petitioner, the outstanding dues shall carry an interest of 6% per annum from the date, the same became due till the date of payment.
