This is the second attempt on behalf of the petitioner for regular bail in connection with Chhatapur P.S. Case No.303 of 2022 registered for the offence under Section 392 of the Indian Penal Code. Subsequently, Section 411 of the Indian Penal Code was also added. Earlier, the bail application of the petitioner has been rejected vide order dated 21.07.2023 passed in Criminal Miscellaneous No.39001 of 2023. 3.

The petitioner and others are said to have looted the motorcycle and Rs.40,000/- from the informant. 4.

At the outset, learned counsel for the petitioner, without accepting the guilt of the petitioner, has submitted that the petitioner is ready to compensate the victim by paying an amount of Rs.4o,000/-.

Considering the aforesaid fact and also considering the period of custody of the petitioner, which is from 06.09.2022, this application is allowed. 6.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Chhatapur P.S. Case No.303 of 2022.

At the time of furnishing the bail bonds, the petitioner shall furnish a demand draft of Rs.40,000/- prepared in the name of the informant. If the petitioner furnishes the demand draft of Rs.40,000/-, the Court below shall accept the bail bonds of the petitioner and hand over the said demand draft to the informant.
