The petitioner seeks regular bail in connection with Pipra P.S. Case No. 95 of 2019 (Special Case No. 7533 of 2019), registered for offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

The allegation against the petitioner, as per FIR, is that police intercepted a motorcycle on which two persons were riding and upon search, the police recovered a total quantity of 75 litres of illicit liquor from the motorcycle kept in a plastic bag.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case inasmuch as the motorcycle from where the illicit liquor

Patna High Court CR. MISC. No.74801 of 2019(2) dt.11-12-2019 2/2 has been recovered does not belong to the petitioner. He further submits that the co-accused, Anand Kumar has already been granted bail by a co-ordinate Bench of this Court. He further submits that the petitioner is in custody since 23.08.2019. Having regard to the submissions made by the parties and taking into consideration the fact that the petitioner has got no criminal antecedent and he is in custody since 23.08.2019, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above-named, be enlarged on bail on furnishing bail bonds of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna in connection with Pipra P.S. Case No. 95 of 2019 (Special Case No. 7533 of 2019).
