1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial no. 306/2024, arising out of Simri Bakhtiyarpur P.S. Case no. 158 of 2024 registered under section 302, 201 and 120B of the Indian Penal Code.

3. As per the prosecution case, the informant states that he received information about a dead body of a lady having been found. On seeing the body it transpired that her throat had been slit and she had bled profusely.

4. Learned counsel for the petitioner submits that the petitioner was falsely implicated in the case on account of his being the husband of the deceased. It has also transpired in course of investigation that at the relevant time, the petitioner

The prosecution is mainly relying on the CDR of the petitioner in so far as it is alleged that the petitioner was in contact with the alleged contract killers. Learned counsel submits that the allegations are circumstantial in nature. He is custody since 19.4.2024 and charge has been framed in the learned trial Court. He undertakes to cooperate in the case/trial.

5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the material that has transpired in course of investigation, the petitioner being in custody for about a year since 19.4.2024 and charge having been framed in the learned trial Court, the petitioner is directed to be enlarged on bail in connection with Sessions Trial no. 306/2024 (arising out of Simri Bakhtiyarpur P.S. Case no. 158 of 2024), on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Saharsa.
