JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-01-2019 The petitioner apprehends his arrest in connection with Katoria P.S.Case No. 74 of 2018 registered under Sections 379 and 411 of the Indian penal Code and 4 and 21 of the Mines and Minerals (Development and Regulation) Act, 1957 and 4 and 40 of the Bihar Minor Mineral Concession Rules, 1972. Allegation as per the FIR is that tractor of theh petitioner was intercepted by the police loaded with sand. Submission of learned counsel for the petitioner is that petitioner is owner of the tractor and even seizure-list shows that only small quantity of sand was found in tractor and moreover, he has no criminal antecedent and is ready to abide by any terms and conditions imposed upon him.
