Petitioner seeks bail in a case registered for the offences punishable under Sections 302/201/34,396,412,120B of the Indian Penal Code.

Submission is that the FIR of the occurrence of robbery of a person and commission of his death is against unknown. During investigation name of the petitioner surfaced in the confessional statement of co-accused wherein allegation of commission of murder is not attributed against the petitioner. Petitioner has got no criminal antecedent. He is in custody since 09.09.2019. Investigation of the case is already complete. There is no material to suggest that the petitioner is going to tamper with the evidence or abscond the process of law.

No.76905 of 2019(2) dt.13-01-2020 2/2 Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Durgawati Police Station Case No.218 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below as well as petitioner shall not leave the country without permission of the Court and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
