2. This is the second attempt of the petitioner for grant of regular bail in connection Samastipur P.S. Case No. 149 of 2024 registered for the offence under Sections 80(2)/123 of B.N.S. Earlier the bail application of the petitioner was rejected vide order dated 22.03.2025 passed in Cr. Misc. No. 89648 of 2024.

3. As per the prosecution case, petitioner is accused of administering poison to his son and his deceased wife. Petitioner is in custody since 05.08.2024 and has no criminal antecedent.

4. From the impugned order, it appears that earlier the case diary was not examined, but after perusal of the case diary

Patna High Court CR. MISC. No.85504 of 2025(3) dt.05-05-2026 2/2 it appears that the petitioner, his wife and son had consumed poison because of heavy loan liability, however, petitioner and his son were saved but his wife died.

5. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. The petitioner undertakes to co-operate in the case/ trial.

6. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

7. Considering the aforesaid facts, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., West Champaran/concerned Court below in connection with Shikarpur P.S. Case No. 975/2022.
