The petitioner is apprehending his arrest in connection with Amba P.S.Case nO.96 of 2018 registered for offences punishable under Sections 406, 420, 34 of the Indian Penal Code.

Allegation against the petitioner is that the petitioner is proprietor of M/S Bhavya Pvt. Ltd. And the allegation is that the work has been allotted to the Agency and allotment was transferred to his agency but only eight ft. semi structure was constructed and thereafter no other work has been done which appears from the FIR and also from the letter of the District Magistrate.

Submission of the learned counsel for the petitioner is that the work has not been allotted to him and he has been

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, and file documents showing that he has not been allotted the work and the same shall be considered by the learned court below on its own without being prejudiced by the order of this Court and if possible to be disposed of on the same day.

With the aforesaid observation, this application is dismissed.
