2. The petitioner seeks regular bail in connection with Konch P.S. Case No. 307 of 2023 for the offence registered under Sections 341, 323, 307, 379, 504, 506 of the I.P.C.

3. As per prosecution case, due to land dispute, the petitioner and other co-accused persons assaulted the informant and his family members with Tangi, lathi etc. causing injury on their head and leg.

4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in the present case due to land dispute between the parties. There is allegation against the petitioner is that he has inflicted Tangi blow on the head of the informant, however, injury report shows

No.84809 of 2023(2) dt.22-01-2024 2/2 that there is no such injury on the head of the informant and the injury report shows that injury is pain and swollen on the back side caused by hard and blunt object which is simple in nature. He further submits that there is case and counter case between the parties due to which both the parties got injured. He further submits that petitioner is handicapped and is in jail custody since 02.07.2023. Petitioner has no criminal antecedent.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions on behalf of the parties and the facts and circumstances of the case, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned court below in Konch P.S.
