The petitioner is languishing in custody since 14.05.2019 in a case registered for the offences punishable under Sections 307, 387, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that for non-fulfillment of extortion demand, the petitioner fired causing injury on the right leg of the informant when co-accused Rampravesh Mahto caused firearm injury on the right hand of the informant. It is submitted by learned counsel for the petitioner that there is a counter version of the occurrence and statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the accusation of firing is specific against the petitioner.

Considering the fact that there is no accusation of repeating the blow and investigation has already been concluded, coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Lakhisarai in connection with Halsi P.S. Case No. 163 of 2018.
