The petitioner, an institution has approached this Court seeking a direction upon the respondent authorities of the State Government to issue necessary order(s) of permission of establishment of the petitioner-institution and thereafter grant necessary order of recognition for conducting ANM (Auxiliary Nurses Midwifery), GNM (General Nurses Midwifery) and

Patna High Court CWJC No.19286 of 2025(2) dt.31-01-2026 2/3 B.Sc Nursing Courses after making physical inspection of the petitioner-institution by a duly constituted team under the provisions of Nurses Training and Recognition Affiliation and conduct of Examination of School of Nursing Rules, 1997.

Learned Advocate for the petitioner referring to the various annexures appended to the writ petition has contended that notwithstanding the No Objection Certificate having been duly issued by the Collectorate, Begusarai as well as by the Civil Surgeon-cum-Chief Medical Officer, Begusarai with the necessary permission for establishment of Nursing Institution conducting ANM, GNM and B.Sc Nursing Courses, till date physical inspection of the petitioner-institution has not been done. It is submitted that other institutions, which had approached this Court, in pursuant to the order of this Court, physical inspection has been done; however, discrimination has been caused and the petitioner has been compelled to approach this Court by filing the present writ petition.

Learned Advocate for the State and the learned Advocate for the Bihar Nurses Registration Council submit at the Bar that regarding recognition and permission for the new institution(s), all the activities are put to stall awaiting the report of the Quality Council of India. However, this Court has been

5. Having considered the submissions advanced by the learned Advocate for the respective parties and taking note of the nature of the grievance, instead of keeping the matter pending, this Court deems it fit and proper to dispose off the present writ petition with a direction to respondents no.2 and 3 to look into the matter and ensure proper physical inspection of the petitioner-institution and take a final decision, preferably within a period of twelve weeks from the date of receipt/production of a copy of this order, in accordance with law.

6. The writ petition stands disposed off.
