Heard.
This application has been filed on behalf of the petitioners for modification of the order dated 20.09.2018 passed in Criminal Misc. No.50195 of 2018 by this Court with regard to extend the period of surrender of the petitioner no.4, namely, Shyamdeo Ram alias Shyamdeo Kumar Ram, in the court below in connection with Jogbani P.S. Case No.95 of 2018.
Patna High Court Cr.Misc. No.75886 of 2018(2) dt.02-01-2019 2/3 Learned counsel for the petitioners submits that vide order dated 20.09.2018 passed in Criminal Misc. No.50195 of 2018 by this Court, the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from that date, were ordered to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Araria, in connection with Jogbani P.S. Case No.95 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C. While the petitioner nos.
1 to 3, above named, surrendered before the court below within time in connection with the aforesaid case but due to unavoidable circumstance, the petitioner no.4, namely, Shyamdeo Ram alias Shyamdeo Kumar Ram, could not surrender before the court below within time in connection with the aforesaid case. In that view of the matter, learned counsel for the petitioners prays for extension of the period of surrender of the petitioner no.4, namely, Shyamdeo Ram alias Shyamdeo Kumar Ram, in the court below in connection with the aforesaid case.
In view of the aforesaid submission of the learned counsel for the petitioners, the period of surrender of the
Patna High Court Cr.Misc. No.75886 of 2018(2) dt.02-01-2019 3/3 petitioner no.4, namely, Shyamdeo Ram alias Shyamdeo Kumar Ram, in the court below in connection with the aforesaid case is further extended for a period of four weeks from today. With the aforesaid modification in the order dated 20.09.2018 passed in Criminal Misc. No.50195 of 2018, this application stands disposed of.
