JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 Petitioner apprehends his arrest in connection with Motipur P.S.Case No. 790 of 2018 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 1765 litres of foreign liquor from the campus of house of the petitioner. Submission of learned counsel for the petitioner nothing has been recovered from his house, rather recovery has been made from open land and he has no criminal antecedent. Heard learned APP also.

Having heard both sides and in view of recovery of huge quantity of wine, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered on

Patna High Court Cr.Misc. No.78240 of 2018(2) dt.07-01-2019 2/2 its own merit, without being prejudiced by this order. With the above observation, this application is dismissed.
