JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 Petitioner apprehends his arrest in connection with Narpatganj P.S.Case No. 397 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 353, 307, 188, 293, 290, 435, 379 and 511 of the Indian Penal Code. Allegation as per FIR is that in an accident when police party came at the place of occurrence several accused persons, including the petitioner have created road blocked and obstructed the police party.
Submission of learned counsel for the petitioner is that there is general and omnibus allegation against 40 accused persons and petitioner has falsely been implicated in this case, having no criminal antecedent and he is only member of mob. Heard learned APP also.
Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.78239 of 2018(2) dt.07-01-2019 2/2 circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Narpatganj P.S.Case No. 397 of 2018, G.R. No. 2093 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in investigation, otherwise his bail bond shall be cancelled.
