====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Tilkeshwar P. S. Case No. 10 of 2024 in a case registered for the offences punishable under Sections 302, 201, 120B of the Indian Penal Code.
3. As per prosecution case, on 12.4.24 informant received information that her daughter, namely, Aarti Devi has been killed by her husband and other in-laws and after killing her, entire family members have left the house and fled away.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case merely because she is mother-in-law of the deceased. Informant has not disclosed as to who informed her about the
Patna High Court CR. MISC. No.82322 of 2025(2) dt.03-12-2025 2/2 alleged incident and that the accused persons committed murder of her daughter. Husband of the deceased has already been granted regular bail by co-ordinate Bench of this Court vide order dated 23.07.2025 passed in Cr. Misc. No. 14681 of 2025. Petitioner is lady, claims clean antecedent and is in custody since 08.09.2025.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation, clean antecedent and period of custody, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Birual, Darbhanga in connection with Tilkeshwar P.
