JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2019 This is an application for grant of anticipatory bail in connection with Kotwali (Purabsarai) P.S. Case No. 378 of 2018, disclosing offences under Sections 30 & 32 of Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 350 liters liquor from a Pickup van and the petitioner is said to be the owner of said vehicle.

Submission of learned counsel for the petitioner is that the Pickup van is under control of the driver and the petitioner was not present there and he was not known about the supply of liquor from his Pickup van. Further, the petitioner has no criminal antecedent.

Having heard both sides, in view of the facts and

Patna High Court Cr.Misc. No.78316 of 2018(2) dt.08-01-2019 2/2 circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender before the learned court below and make prayer for regular bail, which will be considered on its own merit and the learned court below shall try to dispose of the matter, if possible on the same day.
